See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 12, 2024, Ms. Tricker requested the following: [1.] Does the Woodcock Rifle Range meet the environmental standards of the EPA?[;] [2.] ...what lead abatement and mitigation measures are in place?[;] [3.] What, if any, soil and water testing has been conducted?[;] [4.] How does the City of New Bedford, as the owner of the range, mitigate the risk/impact of water runoff?[;] [5.] Is any special treatment afforded to the wetlands that exist within and bordering the parcel of land owned by the City of New Bedford?[;] [6.] Please provide details on any noise testing that has been conducted.[;] [7.] Please provide details of any noise mitigation efforts that have been implemented.[;] [8.] Number of police departments and police academies renting the facility each year for the previous five years[;] [9.] Number of officers shooting at the range each year for the previous five years One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Chief Paul Oliveira SPR24/0470 Page 2 February 22, 2024 [10.] Number of rounds shot by police at the range each year for the previous five years[;] [11.] Number of paying members of the range each year for the previous five years[;] [12.] ... information on the facility's adherence to industry standards, including but not limited to the utilization of proper protective equipment, adherence to established firearm handling guidelines, and the presence of adequate emergency response plans.[;] [13.] …how many instances of stray rounds have occurred in the past five years? Claiming to not yet have received responsive records, Ms. Tricker petitioned this office and this appeal, SPR24/0470, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Ms. Tricker with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
