The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 27, 2024 SPR24/0504 Bryan Smith Town Administrator Town of Erving 12 East Main Street Erving, MA 01344 Dear Mr. Smith: I have received the petition of Paul Hardiman appealing the nonresponse of the Town of Erving (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 27, 2024, Mr. Hardiman requested: [1.] All contract(s) and contract award letter(s) sent to and received by a company called Air Cleaning Specialists of New England, LLC, Hanover, MA (“ACS”). [2.] All Vehicles Exhaust submittals, which, per contract, are required to be submitted and approved before work can begin. [3.] All Flex Track submittals which are required per addendum # 1. [4.] All internal cable based hose system which are required per addendum # 1. [5.] All email correspondence (to and from) any email(s) ending with @erving-ma.gov which were sent to or received by these two [identified] email addresses between the dates of 1/1/2022 through 1/27/24. [6.] A complete copy of the bid submitted to the Town by ACS. Claiming to not yet have received responsive records, Mr. Hardiman petitioned this office and this appeal, SPR24/0504, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Mr. Hardiman with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Hardiman may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
