Flynn, Esq., of the Committee For Public Counsel Services, appealing the nonresponse of the Brockton Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 28, 2023, Attorney Flynn requested: [1.] Copies of all motor vehicle citations completed by [an identified] Officer between July 6, 2022 and present, including but not limited to citations resulting in civil infractions, criminal applications, arrest, and/or warning. [2.] Violator demographic and violation/charge information for all motor vehicle citations issued by [an identified] Officer between July 6, 2022 and present, including but not limited to citations resulting in civil infractions, criminal applications, arrest, and/or warning. [3.] Copies of all reports, including use of force reports, completed by [an identified] Officer between July 6, 2022 and present, including but not limited to reports resulting in no police action, informal police action, arrest, or summons for criminal charges. [4.] Violator demographic and charge information for all reports completed by [an identified] Officer between July 6, 2022 and present, including but not limited to reports resulting in no police action, informal police action, arrest, or summons for criminal charges. [5.] Copies of all motor vehicle citations completed by [an identified] Officer between July 6, 2022 and present, including but not limited to citations resulting in civil infractions, criminal applications, arrest, and/or warning. [7.] Copies of all reports, including use of force reports, completed by [an identified] Officer between July 6, 2022 and present, including but not limited to reports resulting in no police action, informal police action, arrest, or summons for criminal charges. [8.] Violator demographic and charge information for all reports completed by [an identified] Officer between July 6, 2022 and present, including but not limited to reports resulting in no police action, informal police action, arrest, or summons for criminal charges. Claiming to not yet have received responsive records, Attorney Flynn petitioned this office and this appeal, SPR24/0515, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Flynn with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
