Reid Town Clerk Records Access Officer Town of Wayland 41 Cochituate Road Wayland, MA 01778 Dear Ms. Reid: On February 19, 2024, this office received your petition on behalf of the Town of Wayland (Town) seeking an extension of time to produce records, permission to charge for time spent segregating and redacting and a waiver of statutory limits to fees that may be assessed in responding to the request. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Town furnished a copy of the petition to the requestor, Neal McNamara. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On, February 7, 2024, Mr. McNamara requested “disciplinary records/narratives for the following [three] Wayland Police Officers. . .” In an email to the Town and this Division on February 20, 2024, Mr. McNamara “reached out to the RAO to see if [he] can amend [his] request to avoid a fee” and subsequently on February 21, 2024, Mr. McNamara states, “[I] am amending [my] request in an attempt to reduce the number of pages that need to be redacted to hopefully eliminate the need for these additional costs. My request is amended to only cover the portions of the [identified officer’s] investigatory materials…” In light of the above, it is unnecessary to opine on the Town’s petition for an extension of time to produce records, permission to charge for time spent segregating or redacting responsive records and a waiver of statutory limits to fees. Further, this office encourages Mr. McNamara and the Town to continue to communicate to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
