The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 1, 2024 SPR24/0538 Allison Mondello Public Records Manager Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello I have received the petition of William Johnson appealing the nonresponse of the Massachusetts Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 26, 2024, Mr. Johnson requested, “[t]he number of complaints written, emailed, faxed, hand delivered, verbal or by any other means of communication that were submitted by MassDOT Highway Operations Center (HOC), MassDOT employees, contractors and consultants to the Massachusetts State Police relative to towing services and towing companies providing service on all highways (interstate and state routes), turnpikes and roadways. [sic] of the Commonwealth of Massachusetts by individual year for the years 2017, 2018, 2019, 2020, 2021, 2022 and 2023.” Claiming to not yet have received responsive records, Mr. Johnson petitioned this office and this appeal, SPR24/0538, was opened as a result. Subsequently, I learned that the Department intends on providing a response to Mr. Johnson. Accordingly, the Department is ordered to provide Mr. Johnson with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Johnson may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
