The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 28, 2024 SPR24/0561 Shirley Dorai Records Access Officer Malden Public Schools 110 Pleasant Street Malden, MA 02148 Dear Ms. Dorai: On February 12, 2024, this office received your petition on behalf of the Malden Public Schools (School) seeking an extension of time to produce records and requesting permission to charge for time spent segregating and redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the School furnished a copy of the petition to the requestor, Malden News Network. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On February 8, 2024, the requestor sought “…from 2019 to the present,…any and all records – including memos, letters, legal opinions, training materials, emails or other records – related to methods or administrative procedures concerning the Malden School Committee and its handling of meeting minutes. Records of interest relate to public body governance and procedures as well as approval, release, redaction, or posting of minutes from open or executive session Malden School Committee meetings…” In an email to the School and this Division on February 22, 2024, the requestor was “able to narrow the request further…” and subsequently, on February 28, 2024, the School states “[t]he District withdraws its fee petition for SPR24/0561. We will respond to Mr. DeLacey’s new February 22, 2024 public records request within ten business days.” In light of the above, it is unnecessary to opine on the School’s petition for an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records. Further, this office encourages the requestor and the School to continue to communicate to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
