The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 8, 2024 SPR24/0577 Christine Finocchiaro Saugus Police Department 27 Hamilton Street Saugus, MA 01906 Dear Ms. Finocchiaro: I have received the petition of Attorney Emma Hobbs, of Wyckoff Nissenbaum, appealing the response of the Saugus Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 29, 2023, Attorney Wyckoff Nissenbaum, also of Wyckoff Nissenbaum, requested the following: Any and all police, incident and/or team reports and any and all communications with the police either internally or externally regarding [two named individuals]. My office represents Mr. Brawner in a DCF appeal. ... My client would like the video of [a specified] Interview and any reports generated from that interview. This request was the subject of a previous appeal. See SPR24/0156 Determination of the Supervisor of Records (February 1, 2024). In my February 1st determination, I ordered the Department to clarify whether it possessed responsive records, and to either provide the records or cite an exemption of the Public Records Law and explain how such exemption applies to withhold or redact the records. Subsequently, the Department responded on February 1, 2024. Unsatisfied with the Department’s response, Attorney Hobbs further appealed, and this case was opened as a result. Subsequent to the opening of this appeal, I learned that the Department provided a supplemental response by email to Attorney Hobbs and this office on March 8, 2024. As this appeal was opened based on the Department’s February 1st response, I will now consider this administrative appeal closed. If unresolved issues remain, Attorney Hobbs may further appeal the substantive nature of the Department’s March 8th response within ninety (90) days. See 950 C.M.R. 32.08(1).
