See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 8, 2024, Mr. Herman requested “…copies of any and all documents related to physical and mental requirements for active-duty [Town] police officers. I am not asking for records related to training to become a police officer.” Claiming to not yet have received a response, Mr. Herman petitioned this office and this appeal, SPR24/0591, was opened as a result. Subsequently, the Department provided responses on February 26, 2024 and February 27, 2024. The Department sought clarification in its February 27th response. After clarification from the requestor, on March 5, 2024, the Department provided Mr. Herman with a response, which included responsive records. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s March 5th response within ninety (90) days. See 950 C.M.R. 32.08(1).
