See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 11, 2023, Mr. Herman requested “… a copy of the ‘Special Event’ record that involves the September 29, 2022 transport of one or more individuals from Logan Airport to Fenway Park and then back to Logan Airport.” Prior Appeals and In Camera Inspection This request was the subject of prior appeals and an in camera review. See SPR23/2326 Determination of the Supervisor of Records (October 13, 2023); SPR23/2455 Determination of the Supervisor of Records (October 31, 2023) and SPR23/2842 Determinations of the Supervisor of Records (December 8, 2023 and January 24, 2024). In my January 24th determination, I found the Department had met its burden to redact certain information pursuant to Exemption (n) of the Public Records Law. Further, I found that certain personal information may permissibly be redacted under Exemption (c). However, the Department had not met its burden to demonstrate how each redaction falls under Exemption (c) of the Public Records Law. The Department responded on February 26, 2024, Unsatisfied with the Department’s response, Mr. Herman petitioned this office and this appeal, SPR24/0596, was opened as a result. Subsequently, I learned that the Department provided a further response on February 27, 2024, in which the Department advised that the individual(s) who received the escort were not named in the responsive record that was provided to Mr. Herman. Where the basis of this appeal was opened as a result of the Department’s February 26th response, I will now consider this administrative appeal closed.
