General Counsel Massachusetts Executive Office of Energy and Environmental Affairs 251 Causeway Street, Suite 101 Boston, MA 02114 Dear Attorney Mulcahy: I have received the petition of Amanda Alix appealing the nonresponse of the Massachusetts Executive Office of Energy and Environmental Affairs (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 12, 2024, Ms. Alix requested: [1.] All communications, such as emails, text messages, letters, memos, documents, etc., between any Shutesbury Town Official and the MA State Environmental Police regarding a property located at [an identified address] between August 1, 2023, and February 1, 2024; [2.] Any citations/tickets/warnings issued by the Environmental Police to the residents of [an identified address], between August 1, 2023, and February 1, 2024. Claiming to not yet have received responsive records, Ms. Alix petitioned this office and this appeal, SPR24/0615, was opened as a result. Accordingly, the Office is ordered to provide Ms. Alix with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
