See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 8, 2023, Mr. Sosa requested the following: [1.] Any/all report(s), witness interview(s), email(s), audio record of any interviews, transcripts pertaining to file #10-364-AR. [2.] Any/all reports, witness interview(s), e-mail(s), audio recording of any interviews, transcripts pertaining to file #13-15979-OF Adult Record. The City responded to Part 1 of the request on January 8, 2024, denying the request, and citing Exemption (a) of the Public Records Law and G. L. c. 119, § 60A for withholding responsive records. See G. L. c. 4, § 7(26)(a). Unsatisfied with the City’s response, Mr. Sosa appealed, and this case was opened as a result. Regarding Part 1 of the request, subsequent to the opening of this appeal, I learned that the City provided a supplemental response by mail to Mr. Sosa and this office on March 7, 2024. Additionally, I understand the City intends to provide a further response with regard to Part 2 of the request. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Sosa may appeal the substantive nature of the City’s supplemental responses within ninety days. See 950 C.M.R. 32.08(1).
