See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 17, 2024, Mr. Cutler requested, “... all applications of the businesses that applied for ARPA funds for the Town of Spencer.” Prior Appeals The requested records were the subject of prior appeals. See SPR24/0197 Determination of the Supervisor of Records (February 5, 2024) and SPR24/0375 Determination of the Supervisor of Records (February 20, 2024). In my February 20th determination, I found that the Town did not meet its burden of specificity to withhold the records, in their entirety, under Exemption (d) of the Public Records Law. The Town responded on February 28, 2024, February 29, 2024, March 1, 2024 and March 3, 2024. Unsatisfied with the Town’s responses, Mr. Cutler petitioned this office and this appeal, SPR24/0665, was opened as a result. Subsequently, I learned that the Town provided a further response to Mr. Cutler on March 11, 2024. Where this appeal was opened as a result of the Town’s February 28, 2024, February 29, 2024, March 1, 2024 and March 3, 2024 responses, I will now consider this administrative appeal closed. Mr. Cutler may appeal the substantive nature of the Town’s March 11th response within ninety (90) days. See 950 C.M.R. 32.08(1).
