The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 15, 2024 SPR24/0669 Kate Silvia Director of Communications Massachusetts Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Darius Gibson appealing the nonresponse of the Massachusetts Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 3, 2024, Mr. Gibson requested: [1.] Documentation as to the number of years [an identified Department employee]… has been employed by [the Department;] [2.] Documentation as to the number of complaints that have been made against [an identified Department employee;] [3.] Redacted copies of all complaints except the ones made by myself against [an identified Department employee;] [4.] Documentation as to the number of civil actions [an identified Department employee] has won at trial[;] [5.] Documentation as to the number of civil actions [an identified Department employee] has been assigned to[;] [6.] Documentation as to the number of civil actions [an identified Department employee] has been assigned to that resulted in a settlement[.] Claiming to not yet have received responsive records, Mr. Gibson petitioned this office and this appeal, SPR24/0669, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Gibson with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
