Flynn, Esq., of the Committee For Public Counsel Services, appealing the nonresponse of the Massachusetts Department of State Police (Department) to three requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 28, 2023, Attorney Flynn requested the following records: SPR24/0676 “[a]ny policies, procedures, or protocols related to conducting undercover operations.” SPR24/0678 [1.] Press releases, including press posters, related to completed “2022 Brockton Opiate Suppression Initiative” conducted by MSP Gang Unit, CINRET South, Plymouth County State Police Detectives Unit, and Brockton Police. [2.] Planning documentation for completed “2022 Brockton Opiate Suppression Initiative” conducted by MSP Gang Unit, CINRET South, Plymouth County State Police Detectives Unit, and Brockton Police, including but not limited to individuals or geographical areas targeted and any procedures employed in this operation regarding the selection of targets. Claiming to not yet have received responsive records, Attorney Flynn petitioned this office and these appeals, SPR24/0676, SPR24/0678, and SPR24/0681, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Flynn with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
