Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Fiorella Villacrés appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 2, 2024, Ms. Villacrés requested, “…the recording of the train that departed on Tuesday[,] 27 Feb[,] on Washington [S]treet at around 12:00 - 12:25p.m. till Harvard avenue stop[.] It was on the government center direction B line.” The MBTA provided responses on March 4, 2024 and March 5, 2024. Unsatisfied with the MBTA’s responses, Ms. Villacrés petitioned this office and this appeal, SPR24/0683, was opened as a result. Subsequently, I learned that the MBTA provided a further response to Ms. Villacrés on March 15, 2024. Where this appeal was opened as a result of the MBTA’s March 5, 2024 response, I will now consider this administrative appeal closed. Ms. Villacrés may appeal the substantive nature of the MBTA’s March 15, 2024 response within ninety (90) days. See 950 C.M.R. 32.08(1).
