Reboulet Wakefield Police Department 1 Union Street Wakefield, MA 01880 Dear Lieutenant Reboulet: On March 7, 2024, this office received your petition on behalf of the Wakefield Police Department (Department) seeking permission to assess fees for time spent segregating and redacting responsive records and a waiver of statutory limits to fees that may be assessed in responding to the request. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the Department furnished a copy of the petition to the requestor, Daniel J. Larson, Esq., of Larson Law, LLC. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On March 4, 2024, Attorney Larson requested the following information: “with respect to a motor vehicle accident on November 22, 2023 … all the body cam footage leading up to the accident, the scene of the accident, any reports, and notes your office may have.” Subsequently, in an email to this Division on March 8, 2024, Attorney Larson states “…please proceed and [we] will pay the costs of for the redaction.” In light of the above, it is unnecessary to opine on the Department’s petition to assess fees for time spent segregating and redacting responsive records and a waiver of statutory limits to fees. Further, this office encourages Attorney Larson and the Department to continue to communicate to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
