Curran Records Access Officer Town of Billerica 365 Boston Road Billerica, MA 01821 Dear Mr. Curran: I have received the petition of Altin Berxhiku appealing the response of the Town of Billerica (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 19, 2024, Mr. Berxhiku stated, “[i]n this letter to me on 09/07/2021, you mention a petition signed by 19 residents of the neighborhood … As part of my public records request, [I] am asking for a copy of the petition.” The Town provided a March 1, 2024 response asserting, “[we are] responding to acknowledge your public records request. [The Town is] currently working on retrieving the information you requested and expect to have this task completed sometime next week. I will forward all available records to you via email.” Unsatisfied with the Town’s response, Mr. Berxhiku petitioned this office on March 7th, and this appeal, SPR24/0716, was opened as a result. In his petition, Mr. Berxhiku stated, “[the Town] responded on 3/1/2024 that [the Town] will be forwarding these records sometime next week. A whole week has gone by, and [the Town] hasn’t provided [the record] yet.” Subsequent to the opening of this appeal, I learned the Town provided Mr. Berxhiku with a response on March 11, 2024. Where this appeal was opened as a result of the Town’s March 1st response, I will now consider this administrative appeal closed. Mr. Berxhiku may appeal the substantive nature of the Town’s March 11th response within ninety (90) days. See 950 C.M.R. 32.08(1).
