See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On January 22, 2024, Ms. Cote requested, “…a copy of all incident reports, including but not limited to, a motor vehicle fatality that occurred on or about January 15, 2024 involving [an identified individual].” The Department provided a response on January 24, 2024. Unsatisfied with the Department’s response, Ms. Cote petitioned this office and this appeal, SPR24/0718, was opened as a result. Subsequently, I learned that the Department provided a further response to Ms. Cote on March 12, 2024. Where this appeal was opened as a result of the Department’s January 24, 2024 response, I will now consider this administrative appeal closed. Ms. Cote may appeal the substantive nature of the Department’s March 12, 2024 response within ninety (90) days. See 950 C.M.R. 32.08(1).
