The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 3, 2024 SPR24/0855 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 135 Santilli Highway Everett, MA 02149 Dear Ms. Bettencourt: I have received the petition of Rose Caldarone appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 12, 2024, Ms. Caldarone requested “…a total number of all initiated PRS reports initiated from 2019-2020, 2020-2021, 2021-2022, 2022-2023, 2023-2024 for the Plymouth Public School District. . . . [I am] looking for the total number… for each year.” On March 5, 2024, Ms. Caldarone modified her initial request, requesting, “[a]ll PRS complaints, initiated from 2019-2020, 2020-2021, 2021-2022, 2022-2023, 2023-2024 for the Plymouth Public School district - specifically letters of closure, letters of finding and any other dispositional letters related to closed PRS complaints. . . . I asked for the total number of open PRS complaints.” The Department responded on March 5, 2024. Unsatisfied with the response, Ms. Caldarone petitioned this office and this appeal, SPR24/0855, was opened as a result. Subsequently, I learned that the Department provided Ms. Caldarone with a response dated April 1, 2024. Where this appeal was opened as a result of the Department’s March 5th response, I will now consider this administrative appeal closed. Ms. Caldarone may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
