The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 8, 2024 SPR24/0873 Jordan Emily Smock Executive Director & Records Access Officer Roxbury Community College 1234 Columbus Avenue Roxbury, MA 02120 Dear Director Smock: I have received the petition of Colman Herman appealing the response of the Roxbury Community College (College) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 11, 2024, Mr. Herman requested, “... copies of any and all communications between Roxbury Community College and [an identified individual] for the period January 1, 2024 to the present.” Subsequently on March 13, 2024, Mr. Herman modified his request for copies of “... records of anyone who was involved in the hiring of [an identified individual]. This includes, but is not limited to, internal communications and communications with [an identified individual].” The College responded on March 22, 2024. Unsatisfied with the College’s response, Mr. Herman petitioned this office and this appeal, SPR24/0873, was opened as a result. Subsequently, I learned that the College intends on providing a supplemental response to Mr. Herman. Accordingly, the College is ordered to provide Mr. Herman with said response to the request in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the College’s response within ninety days. See 950 C.M.R. 32.08(1).
