The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 8, 2024 SPR24/0883 Seah Levy Records Access Officer City of Cambridge Office of the City Solicitor 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of Daniel Turek appealing the response of the City of Cambridge (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 22, 2023, Mr. Turek requested “[a]ny and all records dated between 1/1/2019 and 3/22/2023, pertaining to [three specified individuals.] Specifically, I seek records pertaining to [a specified individual’s] requests or delivery of her external hard-drive, and any discussion or investigation thereof.” On March 18, 2024, Mr. Turek modified his request, seeking the same records “dated between 1/1/2019 and 3/18/2024…” Prior Appeal The March 22, 2023 request was the subject of a prior appeal. See SPR23/1088 Determination of the Supervisor of Records (June 5, 2023). In my June 5th determination, I found that the City did not meet its burden to withhold responsive records under Exemption (f) of the Public Records Law. The City responded on March 22, 2024. Unsatisfied with the response, Mr. Turek petitioned this office and this appeal, SPR24/0883, was opened as a result. It is my understanding that the City intends on providing a further response to Mr. Turek to address his records request. Accordingly, the City is ordered to provide Mr. Turek with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Turek may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
