The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 29, 2024 SPR24/0888 Joanna Bilotta-Simeone City Clerk Records Access Officer City of Fitchburg 718 Main Street Fitchburg, MA 01420 Dear Ms. Bilotta-Simeone: I have received the petition of Michael O’Farrell appealing the nonresponse of the City of Fitchburg (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 7, 2024, Mr. O’Farrell requested “... files and records created and maintained by the City of Fitchburg concerning the identity and last known mailing address for any individual, firm, business or social organization with unpaid accounts current and updated to the day/date closest to the date of your response but not later than 30 days prior to the date of your response as follows: [1.] Property Tax[;] [2.] Motor Vehicle or Trailer Excise Tax[;] [3.] Water and/or Sewer accounts[;] [4.] Personal Property Excise Tax (Tax on other than motor vehicles or trailers)[;] [5.] Fines and/or penalties imposed for violations of the City Code and/or Zoning Regulations[.]” Claiming to not yet have received responsive records, Mr. O’Farrell petitioned this office and this appeal, SPR24/0888, was opened as a result. Subsequently, I learned that the City provided Mr. O’Farrell with a response dated March 26, 2024. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. O’Farrell may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
