See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 25, 2024, Mr. Gibson requested: [1.] All documentation from 1-9-23 of [an identified individual] speaking to me regarding a prea investigation[;] [2.] All documentation I called internal affairs 1-11-23[;] [3.] Documentation with redactions as to why I.P.S. searched my property 2-7- 23[.] Previous Appeals The requested records were subject the subject of previous appeals. See SPR24/0506 Determination of the Supervisor of Records (February 27, 2024) and SPR24/0652 Determination of the Supervisor of Records (March 14, 2024). In my March 14, 2024 determination, I ordered the Department to identify an exemption that applies to withhold portions of the records from disclosure. The Department provided a response on March 15, 2024. Unsatisfied with the Department’s response, Mr. Gibson petitioned this office and this appeal, SPR24/0894, was opened as a result. It is my understanding that the Department intends on providing a further response to Mr. Gibson. Accordingly, the Department is ordered to provide Mr. Gibson with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Gibson may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
