The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 11, 2024 SPR24/0954 Kerri Ann McManus Town Clerk Town of Georgetown 1 Library Street Georgetown, MA 01833 Dear Ms. McManus: I have received the petition of Kevin Wood appealing the response of the Town of Georgetown (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 5, 2024, Mr. Wood requested the following: [1.] All performance reviews / evaluations for [a named individual] including transmittal sheets [2.] Any communications related to [the individual’s] performance review / employee evaluation to of from [sic] the Selectmen’s office, individual Selectmen, Conservation Commission members or Agent. Previous Appeal This request was the subject of a previous appeal. See SPR24/0551 Determination of the Supervisor of Records (March 6, 2024). In my March 6th determination, I ordered the Town to identify the records it intends to redact or withhold, and to explain with specificity how an exemption applies to withhold or redact the records. Subsequently, the Town responded on March 27, 2024. Unsatisfied with the Town’s response, Mr. Wood further appealed, and this case was opened as a result. Conclusion Subsequent to the opening of this appeal, I learned that the Town provided a supplemental response by email to Mr. Wood and this office on April 1, 2024. As this appeal was opened based on the Town’s March 27th response, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. Wood may further appeal the substantive nature of the Town’s April 1st response within ninety (90) days. See 950 C.M.R. 32.08(1).
