The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 2, 2024 SPR24/0962 Melanie Waddell Town Clerk Town of Rockport 34 Broadway Avenue Rockport, MA 01966 Dear Ms. Waddell: I have received the petition of Robert Bland appealing the nonresponse of the Town of Rockport (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 28, 2024, Mr. Bland requested, “[r]ecords that any of the roads shown on the May 1935 plan may have become public either by statutory compliance with G.L. c. 82, §§ 1-32 or by an adjudication of prescriptive public rights.” Claiming to not yet have received responsive records, Mr. Bland petitioned this office and this appeal, SPR24/0962, was opened as a result. Subsequently, I learned that the Town provided Mr. Bland with a response dated March 28, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Bland may appeal the substantive nature of the Town’s March 28th response within ninety (90) days. See 950 C.M.R. 32.08(1).
