General Counsel Fall River Housing Authority 85 Morgan Street Fall River, MA 02721 Dear Attorney Sousa: I have received the petition of Patrick Higgins appealing the nonresponse of the Fall River Housing Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 15, 2024, Mr. Higgins requested “… a copy of the site license that allowed [an identified individual] to broadcast the movies in the attached poster in March of 2024.” Claiming to not yet have received responsive records, Mr. Higgins petitioned this office and this appeal, SPR24/0975, was opened as a result. Subsequently, I learned that the Authority provided Mr. Higgins with a response dated April 9, 2024. Where this appeal was opened as a result of the Authority’s lack of a written response, I will now consider this administrative appeal closed. Mr. Higgins may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
