The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 11, 2024 SPR24/0991 Lieutenant Joseph Casey Records Access Officer Medford Police Department 100 Main Street Medford, MA 02155 Dear Lieutenant Casey: I have received the petition of Anthony Barry, appealing the nonresponse of Medford Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 21, 2024, Mr. Barry requested “…[a]ll records regarding [an identified individual’s] disciplinary record during his employment at the Medford Police Department or any other law enforcement agency, including but not limited to all internal affairs records, the filing of false reports or affidavits or other documents that proved to be untrue.” Claiming to not yet have received responsive records, Mr. Barry petitioned this office and this appeal, SPR24/0991, was opened as a result. Subsequently, I learned that the Department provided Mr. Barry with a response on April 2, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Barry may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
