Assistant District Attorney Worcester County District Attorney’s Office 225 Main Street, G301 Worcester, MA 01608 Dear Attorney Relation: I have received the petition of Henry Valeria appealing the nonresponse of the Worcester County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 29, 2024, Mr. Valeria requested the following records: [1.] Any and all investigative reports regarding [identified individual][;] [2.] Any formal or informal complaints of racial bias generated from the Worcester County District Attorney’s Office[;] [3.] Any and all criminal cases overturned due to misconduct from [identified individual] or any other District Attorney from Worcester County[;] [4.] Any and all civil lawsuits brought forth against the Worcester County District Attorney’s Office[;] [5.] Any and all federal investigations directed towards the Worcester District Attorney’s Office. Claiming to not yet have received responsive records, Mr. Valeria petitioned this office and this appeal, SPR24/1007, was opened as a result. Subsequently, I learned that the Office provided Mr. Valeria with a response dated April 2, 2024. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Valeria may appeal the substantive nature of the Office’s April 2nd response within ninety (90) days. See 950 C.M.R. 32.08(1).
