City Solicitor City of Melrose 562 Main Street Melrose, MA 02176 Dear Attorney Phillips: I have received the petition of Kathy Curran, of NBC10 Boston, appealing the response of the City of Melrose (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 19, 2024, Ms. Curran requested, “[c]opies of all texts, photos and videos from the department issued cell phone of [an identified individual] from January 1, 2023 to the current day [and] [c]opies of all complaints filed against [an identified individual] from January 1, 2018 to the current day.” The City responded on March 29, 2024. Unsatisfied with the response, Ms. Curran petitioned this office and this appeal, SPR24/1031, was opened as a result. It is my understanding that the City intends on providing a further response to Ms. Curran. Accordingly, the City is ordered to provide Ms. Curran with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Curran may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
