The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 23, 2024 SPR24/1046 Helene Bettencourt Records Access Officer Department of Elementary and Secondary Education 135 Santilli Highway Everett, MA 02149 Dear Ms. Bettencourt: I have received the petition of Colman Herman appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 30, 2024, Mr. Herman requested “all records related to license actions taken by the Department of Elementary and Secondary Education against educators for the period January 1, 2019 to the present.” Following further correspondence, the Department responded on April 2, 2024, providing responsive records in redacted form. Unsatisfied with the Department’s response, Mr. Herman appealed, and this case was opened as a result. Subsequent to the opening of this appeal, based on an email from the Department to Mr. Herman and this office on April 18, 2024, I understand that the Department intends to provide a supplemental response to Mr. Herman. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Herman may appeal the substantive nature of the Department’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
