The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 25, 2024 SPR24/1092 Helene Bettencourt Associate Commissioner Commissioner’s Office Department of Elementary and Secondary Education 135 Santilli Highway Everett, MA 02149 Dear Ms. Bettencourt: I have received the petition of Colin Hogan, of the New Bedford Light, appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 27, 2024, Mr. Hogan requested “…records that demonstrate the following (parentheses indicate the numbered slide of the [specified] PowerPoint where this data was presented:” [1.] How many New Bedford dropouts met the Competency Determination (Slide 12) [2.] How many of New Bedford’s students who did not meet the Competency Determination did not meet local requirements either (Slide 20), including broken down by student demographic (Slide 23) [3.] How many attempts did New Bedford students need to meet the Competency Determination, both in aggregate and by student group (Slide 24) [4.] How many New Bedford students who did meet the Competency Determination used an EPP, in total and by student group (Slide 26) Claiming to not yet have received a response, Mr. Hogan petitioned this office and this appeal, SPR24/1092, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response.
