The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 18, 2024 SPR24/1103 Nick Maroni Deputy Chief Gardner Police Department 200 Main Street Gardner, MA 01440 Dear Deputy Chief Maroni: I have received the petition of Bailey Chokshi Fox, Esq., of Mass Injury Group, appealing the response of the Gardner Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 29, 2024, Attorney Fox requested “…a copy of the entire incident report relative to the following accident [regarding an identified individual]: Date of Accident: 06/25/2023 Location of Accident: [an identified address] Description of Accident: Minor was attacked and bit in the face by a dog; animal control may have been on the scene. She was taken by ambulance to UMass Worcester from the scene of the accident. The Department provided a response on February 6, 2024. Unsatisfied with the Department’s response, Attorney Fox petitioned this office and this appeal, SPR24/1103, was opened as a result. Subsequently, I learned that the Department intends on providing a written response to Attorney Fox. Accordingly, the Department is ordered to provide Attorney Fox with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Fox may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
