The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 29, 2024 SPR24/1118 Jordan Emily Smock Executive Director & Records Access Officer Roxbury Community College 1234 Columbus Avenue Roxbury, MA 02120 Dear Ms. Smock: I have received the petition of Colman Herman appealing the response of the Roxbury Community College (College) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 28, 2024, Mr. Herman requested, “... [r]ecords of all the expenses that [an identified individual] has incurred in her capacity ... of Roxbury Community College for the period April 1, 2023 to the present ... includ[ing] ... [e]xpense reports, including back-up receipts[;] ... [c]redit cards statements, including back-up receipts[;] ... [a]utomobile expense records, including back-up receipts[;] ... [a]ny and all other records that document ... expenses, including back-up receipts[;] [and] ... [t]he written employee reimbursement policy of the Roxbury Community College.” On April 18, 2024, Mr. Herman advised “... on April 17, 2024 ... some ... response records [were produced] ... [b]ut [the College] still did not produce the statements from the credit card company, the back-up receipts (for meals, lodging, transportation, etc.), and the reimbursement policy for employees.” The College responded on April 12, 2024. Unsatisfied with the College’s response, Mr. Herman petitioned this office and this appeal, SPR24/1118, was opened as a result. Subsequently, I learned that the College provided Mr. Herman with a supplemental response dated April 26, 2024. Where this appeal was opened as a result of the College’s April 12, 2024 response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the College’s April 26th response within ninety (90) days. See 950 C.M.R. 32.08(1).
