General Counsel and Director of Government Affairs Massachusetts Technology Collaborative 2 Center Plaza, Suite 200 Boston, MA 02108 Dear Attorney Saubermann: I have received the petition of Brian J. McCarter appealing the response of the Massachusetts Technology Collaborative (Collaborative) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 4, 2024, Mr. McCarter requested, “…all questions asked by attendees in the Q and A on the BEAD challenge process, including the ones not answered. The webinar software said that the host (MBI) has access to everything submitted during the webinar.” On April 13, 2024, the Collaborative provided Mr. McCarter with a response, including responsive records. Unsatisfied with the Collaborative’s response, Mr. McCarter petitioned the Supervisor of Records and this appeal was opened. Subsequent to the opening of the appeal, I learned the Collaborative provided Mr. McCarter with a further response on April 17, 2024, which included responsive records. Where this appeal was opened as a result of the Collaborative’s April 13th response, I will now consider this administrative appeal closed. Mr. McCarter may appeal the substantive nature of the Collaborative’s April 17th supplemental response within ninety days. See 950 C.M.R. 32:08(1).
