Scanlan Primary Records Access Officer Executive Office of Health and Human Services One Ashburton Place Boston, MA 02108 Dear Ms. Scanlan: I have received the petition of John Hilliard, of the Boston Globe, appealing the response of the Executive Office of Health and Human Services (Office) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2024, Mr. Hilliard requested, the following records: [1.] E-mails to or from EOHHS [identified individual] referencing the former Fernald school property in Waltham from Monday, Sept. 18 2023 to present[;] [2.] Text messages to or from EOHHS [identified individual] referencing the former Fernald school property in Waltham from Monday, Sept. 18 2023 to present[.] On April 8, 2024, the Office provided a response. Unsatisfied with the Office’s response, Mr. Hilliard petitioned this office and this appeal, SPR24/1130, was opened as a result. Subsequently, I learned that the Office provided a further response to Mr. Hilliard on April 22, 2024. Where this appeal was opened as a result of the Office’s April 8, 2024 response, I will now consider this administrative appeal closed. Mr. Hilliard may appeal the substantive nature of the Office’s April 22nd response within ninety (90) days. See 950 C.M.R. 32.08(1).
