The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records April 30, 2024 SPR24/1171 Arthur Motta Records Access Officer New Bedford Public Schools 455 County Street, Room 101 New Bedford, MA 02740 Dear Mr. Motta: I have received the petition of Commonwealth Transparency (“requestor”) appealing the nonresponse of New Bedford Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 26, 2024, the requestor sought “… documents/records for your District for the time period February 1, 2024 through March 26, 2024: Any and all email communications which contains ‘1367661’ (without quotes) and/or ‘1367661.v1’ (also without quotes) including any attachments.” Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR24/1171, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the School has provided a response. Accordingly, the School is ordered to provide the requestor with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. The requestor may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
