The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 3, 2024 SPR24/1183 Grace Bannasch Town Clerk Town of Shutesbury Shutesbury Town Hall 1 Cooleyville Road, P.O. Box 264 Shutesbury, MA 01072 Dear Ms. Bannasch: I have received the petition of Thomas Siefert appealing the response of the Town of Shutesbury (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 1, 2024, Mr. Siefert requested “all of the communications that the Town sent and/or received regarding the Shutesbury Athletic Club’s request in April, 2022, to extend their hours for outdoor entertainment[.] … This list includes … the 29 responses that were referred to during the Select Board meeting on April 26, 2022.” The Town responded on April 16, 2024. Unsatisfied with the Town’s response, Mr. Siefert appealed, and this case was opened as a result. Subsequent to the opening of this appeal, based on an email from the Town to this office on May 2, 2024, I understand that the Town intends to provide a supplemental response to Mr. Siefert. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Siefert may appeal the substantive nature of the Town’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
