Legal Counsel/Public Records Officer Executive Office of Housing and Livable Communities 100 Cambridge Street Boston, MA 02114 Dear Attorney Walleigh: I have received the petition of Kelly Dooner, of the Taunton City Council, appealing the nonresponse of the Executive Office of Housing and Livable Communities (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 20, 2024, Ms. Dooner requested “…all public records that have come into your possession concerning the following:” [1.] Are background checks being done before placement? [2.] How many background checks have been accomplished? [3.] How long does a background check take? [4.] Are they given housing before the background check is completed? [5.] If a name cannot be found on any database, how are you verifying the person is who they say they are? [6.] Are we cross checking with fingerprints with police databases? [7.] If you find a person with a record, what happens? If they have an outstanding warrant, are the police notified? If they have a past record and have served their time, are they still granted housing? Claiming to not yet have received responsive records, Ms. Dooner petitioned this office and this appeal, SPR24/1187, was opened as a result. Subsequently, I learned that a representative from the Office intends on providing a written response to Ms. Dooner. Accordingly, the Office is ordered to provide Ms. Dooner with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
