The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 7, 2024 SPR24/1244 Tracey Blais Town Administrator Town of Newbury 25 High Street Newbury, MA 01951-4799 Dear Ms. Blais: I have received the petition of Jack Rybicki appealing the nonresponse of the Town of Newbury (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 9, 2024, Mr. Rybicki requested “bids/prices/estimates, or any similar documents related to the proposed 2 million dollar HVAC project at NES as submitted to town leadership.” Claiming to not yet have received a response, Mr. Rybicki petitioned this office and this appeal, SPR24/1244, was opened as a result. Subsequently, I learned that the Town provided Mr. Rybicki with responses on April 27, 2024 and April 29, 2024. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Rybicki may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
