The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 16, 2024 SPR24/1337 Jessica Spanknebel Town Clerk Town of Hadley 100 Middle Street Hadley, MA 01035 Dear Ms. Spanknebel: I have received the petition of Susan Delmolino appealing the response of the Town of Hadley (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 18, 2024, Ms. Delmolino requested: all executive session minutes regarding the purchase of the building next to the current DPW. I know that there were several executive sessions; however, some were misidentified on the agendas so rather than list dates, I am asking for the minutes from all executive sessions that were held. On April 3, 2024 the item is listed as 234 Middle Street Determination of Unique Propery (sic) and Intent to Purchase. It is described differently on different agendas. The proposed purchase is now on the Town Meeting Warrant, so there is no longer a need to shield the executive sessions. On April 24, 2024, Ms. Delmolino modified her April 18th request to include, “. . . all the executive session minutes for 2023 and 2024.” On May 1, 2024, the Town provided a response. Unsatisfied with the Town’s response, Ms. Delmolino petitioned this office and this appeal, SPR24/1337, was opened as a result. Subsequent to the opening of this appeal, it is my understanding that the Town provided a supplemental response on May 9, 2024. Where this appeal was opened as a result of the Town’s May 1st response, I will consider this administrative appeal closed. Ms. Delmolino may appeal the substantive nature of the Town’s May 9th response within ninety (90) days. See 950 C.M.R. 32.08(1).
