Assistant District Attorney Records Access Officer Norfolk District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Hunt: I have received the petition of Brian E. Barreira, Esq. appealing the nonresponse of the Norfolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 17, 2024, Attorney Barreira requested the following records for the time period of August 23, 2023 through and including September 15, 2023: [1] All communications from [two Attorneys] and any subsequent communications back and forth with each such recipient regarding the video[;] [2] Communications by DA . . . and/or Assistant DA . . . in making alerts about the upcoming video before its issuance. Claiming to not yet have received responsive records, Attorney Barreira petitioned this office and this appeal, SPR24/1338, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Attorney Barreira with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Barreira may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
