Devito Sergeant | Records & Scheduling Billerica Police Department 6 Good Street Billerica, MA 01821 Dear Sergeant Devito: I have received the petition of Altin Berxhiku appealing the nonresponse of the Billerica Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 18, 2024, Mr. Berxhiku requested “the 911 call [an identified individual] placed on 3/24/2024”. Claiming to not yet have received a response, Mr. Berxhiku petitioned this office and this appeal, SPR24/1344, was opened as a result. Subsequently, I learned that the Department provided Mr. Berxhiku with responses on April 29, 2024 and May 6, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Berxhiku may appeal the substantive nature of the Department’s responses within ninety (90) days. See 950 C.M.R. 32.08(1).
