Avery: I have received the petition of Attorney Marcus Kuhs appealing the nonresponse of the Lynn Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 5, 2024, Attorney Kuhs requested “any reports, memos or FIO’s written by [an identified individual] from January 1, 2022 to September 30, 2023.” Claiming to not yet have received responsive records, Attorney Kuhs petitioned this office and this appeal, SPR24/1362, was opened as a result. Subsequently, I learned that the Department provided Attorney Kuhs with a response dated May 14, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
