The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 22, 2024 SPR24/1396 Michael Tencellent Records Access Officer Department of Conservation and Conservation 251 Causeway Street, 9th Floor Boston, MA 02114 Dear Mr. Tencellent: I have received the petition of Alan DiPietro appealing the response of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 5, 2024, Mr. DiPietro requested copies of: all cutting plan fillings and findings, (Dis)approval(s), appeals decisions etc. regarding the cutting plans submitted by . . . MA Forester License #210 for . . . at [a specified address] for the years of 2019 and 2020. Forest Cutting Plan (File #286-21470-20 or others) (Land off Maple Street in Stow and Bolton, Massachusetts). Also please provide all correspondence mailed, emailed etc. with the Town of Bolton and the Town of Stow, employees thereof or any other individuals or organizations regarding the cutting plans etc. submitted by . . . MA Forester License #210 for . . . at [specified addresses] for the years of 2019 and 2020 Forest Cutting Plan (File #286-21470-20 or others (Land off Maple Street in Stow and Bolton, Massachusetts). On April 1, 2024, the Department provided Mr. DiPietro with a response, including some responsive records. Unsatisfied with the Department’s response, and claiming that he did not receive all the requested records, Mr. DiPietro, petitioned this office and this appeal, SPR24/1396, was opened as a result. Subsequent to the opening of this appeal, I learned that the Department provided Mr. DiPietro with a further response and the requested records on May 15, 2024. Where this appeal was opened as a result of the Department’s April 1st response, I will now consider this administrative appeal closed. Mr. DiPietro may appeal the substantive nature of the Department’s May 15th response within ninety calendar days. See 950 C.M.R. 32.08(1).
