The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 21, 2024 SPR24/1420 Lilian Malo Records Access Officer Wellesley Public Schools 40 Kingsbury Street Wellesley, MA 02481 Dear Ms. Malo: I have received the petition of Joanne McIntosh appealing the response of the Wellesley Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 4, 2024, Ms. McIntosh requested: All emails, text messages and other correspondence that satisfy all of the following criteria: [1.] Mention the words and phrases “Spirit Week”, “Freedom Friday”, “Fitness Friday”, “America”, “flag”, “25 News”, “[a named individual]”, “USA day”, “USA theme” [2.] Where the following individuals are either recipients or senders… [3.] Exclude emails of students with @wpsraiders.org in the email address. [4.] Exclude any emails where town counsel are recipients. The School responded on April 12, 2024. Unsatisfied with the response, Ms. McIntosh petitioned this office and this appeal, SPR24/1420, was opened as a result. It is my understanding that the School intends on providing a further response to Ms. McIntosh to address her records request. Accordingly, the School is ordered to provide Ms. McIntosh with said response in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. McIntosh may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
