The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 21, 2024 SPR24/1432 Mark Smith Records Access Officer North Brookfield Police Department 55 School Street North Brookfield, MA 01535 Dear Mr. Smith: I have received the petition of Harold Blankenship appealing the nonresponse of the North Brookfield Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 12, 2024, Mr. Blankenship requested “materials and documents in reference to … any incidents at [an identified location] or anywhere in North Brookfield Massachusetts on April 16, 2024 between 13[:]45 and 16[:]45 regarding me or my son..” Claiming to not yet have received responsive records, Mr. Blankenship petitioned this office and this appeal, SPR24/1432, was opened as a result. Subsequently, I learned that the Department provided Mr. Blankenship with a response dated May 14, 2024. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Blankenship may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
