Devito Sergeant/Records & Scheduling Billerica Police Department 6 Good Street Billerica, MA 01821 Dear Sergeant Devito: I have received the petitions of Altin Berxhiku appealing the responses of the Billerica Police Department (Department) to two requests for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). SPR24/1440 On May 8, 2024, Mr. Berxhiku requested “the physical fitness results for [two named] police officers.” The Department responded on May 10, 2024, stating, “there are no records responsive to ... this request.” SPR24/1441 On May 12, 2024, Mr. Berxhiku requested “the initial physical ability test results and the subsequent test results every 4 years for [a named police officer].” The Department responded on May 13, 2024, stating, “there are no records responsive to ... this request.” Unsatisfied with the Department’s responses, Mr. Berxhiku petitioned this office and these appeals, SPR24/1440 and SPR24/1441, were opened as a result. Based on a telephone conversation between this office the Department on May 20, 2024, I understand that the Department intends to provide a supplemental response to Mr. Berxhiku. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its Regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Berxhiku may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
