Devito Police Sergeant Records and Scheduling Billerica Police Department 6 Good Street Billerica, MA 01821 Dear Sergeant Devito: I have received the petition of Altin Berxhiku appealing the response of the Billerica Police Department (Department) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On May 9, 2024, Mr. Berxhiku requested, “[o]n Sep 1-st between 5pm – 7pm, [I] received a phone call from one of your officers, [an identified officer]. I am asking for a transcript or audio file of the call.” The Department provided a response on May 13, 2024. Unsatisfied with the Department’s response, Mr. Berxhiku petitioned this office and this appeal, SPR24/1446, was opened as a result. Subsequently, I learned that the Department provided a further response to Mr. Berxhiku on May 15, 2024. Where the basis of this appeal was opened as a result of the Department’s May 13, 2024 response, I will now consider this administrative appeal closed. Mr. Berxhiku may appeal the substantive nature of the Department’s May 15, 2024 response within ninety (90) days. See 950 C.M.R. 32.08(1).
