The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 28, 2024 SPR24/1449 Kate Silvia Director of Communications Records Access Officer Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Darius Gibson appealing the response of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 24, 2024, Mr. Gibson requested: [1] All emails between [identified individuals] mentioning [an identified individual’s] 2023 public records request[;] [2] An index of all emails between [identified individuals] mentioning . . . 2023 public records request[.] Prior Appeals The requested records were the subject of prior appeals. See SPR24/0507 Determination of the Supervisor of Records (February 29, 2024) and SPR24/0948 Determination of the Supervisor of Records (April 9, 2024). In my April 9th determination, I found that upon review of the Department’s response and privilege log, the Department must provide the substance of each of the records as required by G. L. c. 66, § l0A(a). The Department responded on April 22, 2024. Unsatisfied with the Department’s response, Mr. Gibson petitioned this office and this appeal, SPR24/1449, was opened as a result. It is my understanding that the Department intends on providing a further response to Mr. Gibson. Accordingly, the Department is ordered to provide Mr. Gibson with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Gibson may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
