The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 29, 2024 SPR24/1455 Seah Levy Public Records Access Officer City of Cambridge 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of David Calhoun appealing the response of the City of Cambridge (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 27, 2024, Mr. Calhoun requested, “... an electronic copy of all emails sent or received by [an identified individual] on the following dates June 22, 2023, June 23, 2023, June 24, 2023.” Prior Appeal The requested records were the subject of a prior appeal. See SPR24/1065 Determination of the Supervisor of Records (April 24, 2024). In my April 24th determination, I found that where the City indicated that it intends to provide a response within the allowed statutory timeframe, the basis of Mr. Calhoun’s appeal was unclear. On May 14, 2024, Mr. Calhoun clarified his appeal and advised that he had not received the requested records and this appeal, SPR24/1455, was opened as a result. It is my understanding that the City intends on providing a further response to Mr. Calhoun. Accordingly, the City is ordered to provide Mr. Calhoun with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Calhoun may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
